California rental rules to build into your agreement
California regulates how rental companies sell damage waivers. Under Civil Code § 1939.09, the waiver for standard car classes has a daily price cap that is adjusted each January for inflation. Before the sale, the company must clearly disclose the renter's liability, that the renter's own insurance or credit card may already cover it, and the price range of the waiver. Renters who are not members of the company's program must also hear that the waiver may duplicate their own coverage, and must initial next to the accept or decline choice.
